Terms of Service
These terms are an agreement between you, and the organization you use Hirepup for, and Intracker, Inc., a Delaware corporation (“we”, “us”), which operates Hirepup. By creating a workspace or using Hirepup, you agree to them.
1. The service
Hirepup turns a job description into a requirement profile you can edit, searches professional profiles for people who fit it, and gives you a ranked, explained shortlist. We improve it continually, so features may change; we will not remove something you pay for in a way that takes away its main purpose without telling you first.
2. Accounts
- Hirepup is for business use by people aged 18 and over.
- Give accurate information, keep your sign-in safe, and do not share it. You are responsible for what happens in your account.
- The person who creates a workspace is its administrator and decides who else may use it.
3. Free trial and credits
- A new workspace starts with free trial credits, once. Creating extra workspaces to get more free credits is not allowed.
- Searches and some other actions use credits; what each costs is listed on the Credits page in the app. A search that finds too few people, or fails, costs nothing.
- Credits have no cash value and cannot be transferred or exchanged. A plan's monthly credits can be used until the end of the following billing period; credits from a top-up pack, for 12 months; trial credits do not expire.
- We may change what actions cost in credits. Changes apply from when we announce them and never to credits already spent.
4. Plans, billing and cancellation
- Paid plans are billed monthly in advance, in US dollars, through Stripe. Prices do not include taxes, which are added where they apply.
- You can cancel at any time. Your plan then stays active until the end of the period you have paid for, and is not renewed.
- Fees and credits are not refundable, except where the law requires it.
- If a payment fails, we may move the workspace to the free plan until it is paid.
5. Acceptable use
Use Hirepup only to find and approach people for real roles, lawfully. In particular, do not:
- Discriminate against anyone, or use Hirepup in any way that breaks employment, anti-discrimination, privacy or anti-spam laws.
- Use Hirepup or its data to decide anyone's eligibility for credit, insurance, housing or similar, or as a background check. Hirepup is not a consumer reporting agency and its information is not a consumer report.
- Copy, scrape, resell or redistribute candidate data, or use it to build a database or product of your own.
- Try to get around credits, limits or security, reverse engineer Hirepup, or disrupt it.
- Harass, threaten or mislead anyone you contact.
6. Candidate data and your responsibilities
You decide whom to contact and how, and you are responsible for doing so lawfully: say who you are and why you are getting in touch, and honour any request to stop. Keep candidate information only as long as you need it for the role, and delete it when you no longer do. If a candidate asks you to delete their information, do so and tell us at privacy@hirepup.ai so we can remove them too.
7. Scores are aids, not decisions
Scores, explanations and AI assessments are there to help you decide where to look first. They can be wrong or incomplete, because profiles can be out of date or say little. Review the people yourself before acting; every decision about whom to contact or hire is yours.
8. Your content and ours
You own the job descriptions, notes and other content you put into Hirepup, and you let us use it only to provide and improve the service for you. Hirepup itself, including its software, scoring and design, belongs to us; these terms give you the right to use it, not to own it.
9. Other services
Payments go through Stripe, and you may sign in with Google. Those services have their own terms, which apply when you use them.
10. Suspension and ending
You can stop using Hirepup and close your workspace at any time. We may suspend or close a workspace that breaks these terms or puts others at risk, and we will tell you why unless the law or safety prevents it. See the Privacy Policy for what happens to your information afterwards.
11. Disclaimers
Hirepup is provided “as is” and “as available”. To the extent the law allows, we make no promises beyond those in these terms, including that it will always be available, error-free, or find the right person for every role.
12. Limits on liability
To the extent the law allows, neither of us is liable to the other for indirect or consequential losses, such as lost profits or lost data, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose.
13. Your promise to us
If someone makes a claim against us because of how you used Hirepup or the candidate data in breach of these terms or the law, you will cover our reasonable costs of that claim.
14. Governing law
These terms are governed by the laws of the State of Delaware, and the state and federal courts in Delaware have exclusive jurisdiction over any dispute about them.
15. Changes and contact
If we change these terms we will update the date at the top and tell administrators by email or in the app before a significant change takes effect; using Hirepup afterwards means you accept the new terms. Questions: support@hirepup.ai.
